GENERAL TERMS OF BUSINESS

§ 1 Validity
The following General Terms of Business (GTB) form the only basis for whatever legal relationship has been established between the firm Solvaig Nail Paintings and its customers. They are valid in the version relevant at the moment when the contract is concluded; this version can be read, saved and printed free of charge under www.solvaig.de .
§ 2 Conclusion of Contract
(1)The presentaion of the products under www.solvaig.de does not include a binding offer of the firm Solvaig Nail Paintings. It must be understood as a request for the customer to submit a binding offer to the firm Solvaig Nail Paintings.
(2)By ordering the customer submits a binding offer. The order can be made either by fax or online. The fax ordering form can be downloaded from the website www.solvaig.de. The online ordering form can also be downloaded from the same website. By mailing the order the customer acknowledges the General Terms of Business as the only relevant basis for the legal relationship with the firm Solvaig Nail Paintings.
(3)The firm Solvaig Nail Paintings will then confirm the reception of the customer’s order by a written message (letter, fax, e-mail). This confirmation does not represent a binding acceptance of the order.
(4)The contract is concluded either if the firm Solvaig Nail Paintings mails a formal approval of the order or if the ordered products are shipped to the customer.
§ 3 Prices and Payment Conditions
(1)The prices current at the time of ordering are valid for the order. All prices indicated in the online shop of the firm Solvaig Nail Paintings are final prices including V.A.T..
(2) Shipping costs have to be paid by the customer in addition to the merchandise costs. Shipping amounts to € 4,50 within Germany and € 20,00 for destinations abroad.
(3)The payment of the purchase price without any reduction is due with concluding the contract.
(4)Payment may be made by money order, invoice, cash on delivery or direct debit authorization.
§ 4 Delivery, Passing of Risk, Reservation of Ownership
(1) Delivery of the products will be done at the address indicated by the customer not later than 4 days after receipt of payment.
(2) Delivery takes place within 4 days after ordering, if the customer orders the products as an entrepreneur. The same applies to cash on delivery.
(3) The merchandise remains property of the firm Solvaig Nail Paintings until the full payment has been executed.
(4) If, in spite of a concluded contract of sale, the ordered products cannot be delivered in time or not at all, the firm Solvaig Nail Paintings will give notice to the customer immediately. In such a case the customer is free either to wait for the merchandise or to refrain from the contract; if delivery is impossible, both parties have the right to withdraw from the contract. In the case of a withdrawal the customer will promptly be reimbursed for a payment which he might have effected.
(5) The firm Solvaig Nail Paintings is authorized to choose partial delivery if this is deemed acceptable to the customer. Should the firm Solvaig Nail Paintings decide to make partial delivery, there will not be any extra charge for delivery. Such a charge will only be made if the customer has expressly asked for partial delivery.
§ 5 Rights of the customer in case of deficiency
In case of deficiency, the rights of the customer for claiming supplementary performance, for withdrawal from the contract or for price reduction are determined by legal regulations. In case of indemnity claims in addition to or instead of the performance, the rules of § 6 are applied.
§ 6 Liabilities
(1) The firm Solvaig Nail Paintings is not liable for slight negligence of duty except for an essential part of the contract or an injury of life, body or health. The liability defined by the Produkthaftungsgesetz (bill of liability concerning the product) is not part of this §6 (1).
(2) If nevertheless the firm Solvaig Nail Paintings accepts liability for any slight negligence, liability is limited to predictable defects essentially connected with the contract.
(3) As far as liability of the firm Solvaig Nail Paintings is excluded or limited, the rules of §6 (1) and (2) are also valid for members of the firm, persons employed by the firm and legal representatives.
§ 7 Data Protection
(1) Personal data which the customer communicates optionally when making the order will be used exclusively according to the law, i. e. Bundesdatenschutzgesetz (BDSG) and Telemediengesetz (TMG) [ bill of protection of personal data, bill of the use of the media].
(2) Information about data protection can be read under www.solvaig.de at any time by using the button Datenschutzhinweise.
§ 9 Right of Revocation
If the customer orders products from the firm Solvaig Nail Paintings as a consumer, he has the right of revocation.
INFORMATION ABOUT CANCELLATION
Information about Cancellation:
You may cancel the contract by a written statement (letter, fax, e-mail) within two weeks without giving any reasons or – if you have received the thing before the expiry of the date – by sending the merchandise back. The two weeks start with the reception of this Information about Cancellation, but not before the arrival of the mechandise at the customer’s address (repeated delivery of equal products: not before delivery of the first part) and also not before our information given according to § 312c Abs. 2 BGB i.V.m. § 1 Abs. 1, 2 and 4 BGB-InfoV and also not before fulfilment of our duty according to § 312e Abs. 1 Satz 1 BGB i.V.m. § 3 BGB-InfoV.To meet the deadline it is sufficient to dispatch the cancellation or the merchandise within the delay mentioned above.

Effects of a cancellation:
In the case of a justified cancellation both partners have to return the things or achievement and, if appropriate, the benefit from their use. If you can only return the achievement partially or in a deteriorated form, you must make amends for its proper value. This does not apply to the provisioning of things, if the deterioration is exclusively due to their examining – as is the case in a retail shop, for example. Apart from that, you can avoid the duty of value compensation by not using it as your personal property and by refraining from doing anything that might harm its value. Things that can be sent as a parcel should be posted at our risk. You have to pay the return costs if - the goods delivered correspond with the order and if the price of the products to be returned is under 40,00 €URO - or if the value is above this sum and if at the time of the cancellation you have not effectuated the payment or performance required or made a partial payment as agreed with the firm.In all other cases the returning of the things is free of charge. Things which cannot be sent by parcel or packet will be collected at your house. Any duties of payment have to be met with within 30 days. This period of time starts by dispatching your declaration of cancellation or of the thing, for us it starts with the reception.
§ 11 Final Regulations
(1) The right of the customer to charge against the firm Solvaig Nail Paintings only exists, if his demand has been legally proved or is evident.
(2) The laws of the German Federal Republic are valid, the commercial rights of the UN are excluded. The implementaion of laws of the state in which the customer normally lives, however, is not touched by this choice of laws and rights.
(3) For legal conflicts about agreements mentioned in these GTB the competent court of jurisdiction is Bad Endbach, if the customer has made an order as an entrepreneur.
(4) If one or more regulations of these General Terms of Business are or become ineffective or inexecutable, this does not affect the validity of the other regulations. The ineffective or inexecutable rule has to be replaced by a rule which comes as close as possible to the intention of the parties for the original arrangement. This also applies to any omissions in the contract.

2. The language of contract
The language used for the contracts is German exclusively.
3. Conclusion of Contract
The presentation of the products in the online shop is not to be understood as a legally binding offer. It is a request for the customer to make a mandatory offer to the vendor by sending in his order. This may be done using the WEB ordering form to be found at www.solvaig.de or by using a fax ordering form also available from the same website. The contract is concluded only when the firm Solvaig Nail Paintings declares the acceptance of the order or sends out the products.
4. Correction of input errors
Before mailing his order, the customer has the chance to check the details of the contract which are presented in a summary and to correct any input errors that might occur.
5. Price of the merchandise
For the order, prices current at the time of ordering are valid. The vendor reserves the right to change prices of the online shop before conclusion of the contract. Should any price be altered after the receipt of an order, the firm’s letter of confirmation of the order is to be understood as a modification of the firm’s original offer, so that the contract is concluded only by the special acceptance of the customer. All prices are final prices including V.A.T. The retail price is due with the contract conclusion.
6. Shipping and Payment Costs
The costs for shipping and payment are added to the retail prices. Payment may be done by money order, invoice, cash on delivery or direct debit authorization. If the products are sent by cash on delivery, the customer pays the price to the transport firm directly, with an additional amount of € 4,50. Shipping costs in Germany amount to € 4,50. For the delivery to destinations abroad we charge € 20,00 for any value of the order.
